These terms and conditions outline the rules and regulations for the use of The Lazy Tulip Cafe’s website, including ordering food online.

By accessing this website we assume you accept these terms and conditions in full. Do not continue to use The Lazy Tulip Cafe’s website if you do not accept all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of Canada. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
ORDERING FOOD ONLINE
Purchases for online food orders with The Lazy Tulip Café can be done safely online through our secure payment processor, Elavon.
When we finalize the order the purchase contract will be considered valid whether or not your payment has been processed immediately. The purchase contract remains true unless we have notified you that we do not accept your order, or if you have cancelled your order.
We may refuse to accept an order:
(a) Where we cannot obtain authorization for your payment
(b) If there has been a pricing or menu description error
(c) If the food item has been sold out and becomes unavailable i.e. sold out or unavailable due to unforeseen circumstances.
All prices are in Canadian Funds.
AVAILABILITY OF FOOD ORDERS – CURBSIDE PICKUP ONLY
All orders made online must be paid for in advance. Online orders will be available for curbside pickup at The Lazy Tulip Café, located at 29 Maple Avenue, Barrie, ON L4N 1R7. You will receive notification that your order is ready to pickup by text to the mobile phone number you provided, and by email to the email address you provided with your order. We appreciate your prompt response to the notification so that you may receive the prepared food order at its best. Online orders will be accepted only until our “closing hours”; curbside pickup will remain open for 30 minutes after the notification has been sent. We cannot be responsible for online orders placed, paid for but not picked up.
Menu items may contain or come into contact with wheat/gluten, eggs, peanuts, tree nuts, milk, soy and sesame. We are happy to be able to accommodate dietary preferences, however, we do not have food preparation areas that are entirely free of allergens. If you have a serious allergy please call us at 705-252-0910. Gluten free bread is available for an extra $1 per slice.
LICENSE / PROPRIETARY RIGHTS
Unless otherwise stated, The Lazy Tulip Cafe and/or it’s licensors own the intellectual property rights for all material on The Lazy Tulip Cafe. All intellectual property rights are reserved. You may view and/or print pages from https://lazytulipcafe.com/ for your own personal use subject to restrictions set in these terms and conditions.
You must not:

- Sell, rent or sub-license material from https://lazytulipcafe.com/
- Reproduce, duplicate or copy material from https://lazytulipcafe.com/

To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
In order to provide the best customer satisfaction, we offer the following solutions. Feel free to contact us if you have any questions regarding the Return & Refund Policy by emailing us at the restaurant. For immediate response, please call the restaurant at 705-252-0910. Preparation of your order can begin immediately after your order has been confirmed. We cannot accept cancellations once your order has been confirmed with the restaurant.
Food Order Errors
If your order was not correctly prepared as per the confirmed order please call us at 705-252-0910 as soon as possible. Each food order error is unique, therefore there is no cookie cutter answer on how it’s best handled. Kindly let us know what happened and each order will be dealt with at that time.
We may ask for a photo of your order by emailing it to us. Should a refund be required you will be refunded to the method of payment of your original purchase. A store credit may be offered to you or a full replacement of the product.
Incomplete Food Orders
In the rare occasion that you do not receive food that is on your receipt, we will make it up to you. Please call us directly or your third-party delivery service as soon as you notice that any food items were not received in your order.
Please note: we do provide courtesy items such as disposable silverware, chopsticks, etc. when requested for free. If we mistakenly omit a free courtesy item you are welcome to let us know so we may address the issue with our staff, however, we cannot provide discounts, refunds or store credit.
All our dishes are made to order using the freshest of ingredients. We take great care in the preparation of the order. Refunds and/or replacement food are available upon request for orders in which the food is wrong, omitted and other similar circumstances.
Sorry, we cannot cancel, refund or give store credit if you change your mind or mistakenly order an item after the order is prepared.
Order Cancelled Delivery Partner
It’s possible your delivery partner might cancel the delivery if they’re unable to find or reach you. When they arrive at your delivery address, they’re prompted to contact you so it’s a good idea to keep your phone nearby when you’re expecting the food to arrive. If a delivery partner made a reasonable effort to contact you after arriving at your requested location, you may not be eligible for a refund.
Sorry, we cannot provide a refund or cash value on any complimentary food.
As a private business, it is the right of the restaurant to deny or refuse service to any customer for any reason. If a customer abuses any of the Return & Refund Policies we, unfortunately, will not be able to conduct future business with the customer so that we may continue to provide excellent and quality food and service for you and our other wonderful and frequent patrons.
Please note: we strive to prepare and package our pick up items to preserve the high quality of the food. Keep in mind the temperature, sauce, and consistency of some items may vary slightly after being packaged.
